Use of Puzl Cloud Platform services (the Services) is subject to this Acceptable Use Policy. This Policy describes prohibited uses of the Services offered by Puzl Cloud. 

The examples described in this Policy are not exhaustive. Puzl Cloud may modify this Policy at any time by posting a revised version at [{{serviceName}}]({{serviceUrl}}) (and any successor or related locations designated by us). By using the Services or accessing {{serviceName}}, you as Customer agree to the latest version of this Policy. If you violate the Policy or authorize or help others to do so, Puzl Cloud may suspend or terminate your use of the Services. 

Capitalized terms have the meaning stated in the applicable agreement between you and Puzl Cloud.

Customer agrees that the Service may only be used for lawful purposes in accordance with all current and future laws, statutes and regulations in force from time to time in the country (or countries) in which the Service is being used ("Laws"). Customer agrees not to, and not to allow third parties to use the Services:

- to violate, or encourage the violation of, any Laws and the legal rights of others (for example, this may include allowing Customer End Users to infringe or misappropriate the intellectual property rights of others in violation of legal acts);
- to engage in, promote or encourage illegal activity;
- for any unlawful, invasive, infringing, defamatory or fraudulent purpose (for example, this may include phishing, creating a pyramid scheme or mirroring a website);
- to intentionally distribute viruses, worms, Trojan horses, corrupted files, hoaxes, or other items of a destructive or deceptive nature;
- to interfere with the use of the Services, or the equipment used to provide the Services, by customers, or other authorized users;
- to disable, interfere with or circumvent any aspect of the Services;
- to generate, distribute, publish or facilitate unsolicited mass email, promotions, advertisings or other solicitations (“spam”); or
- to use the Services, or any interfaces provided with the Services, to access any other Puzl Cloud product or service in a manner that violates the terms of service of such other Puzl Cloud product or service;
- to operate certain network services, like, but not limited to VPN, TOR, proxi-servers, open mail relays, or open recursive domain name servers, that might abuse the network.

CPU is a type of Kubernetes compute resources measured in CPU units (vCPU on Puzl). On Puzl, 1 vCPU is equivalent to one thread of AMD EPYC 2nd Gen core, 2.5GHz or higher.

## Billing

## Exclusive and shared cores

Some calculations require using exclusive CPU cores, otherwise performance may drop due to high L3 cache utilization. To request exclusive cores, you should set vCPU as an integer number.

Exclusive CPU cores are used only by you. To prevent cross-socket traffic they are allocated on the same CPU socket, and, if [GPU](/resources/gpu) is requested, on the same socket with GPU (if there are free GPUs on this socket).

## Restrictions

1. Puzl doesn't support vCPU units less than `1m` like `n` and `u`. See more about [CPU units in Kubernetes](https://kubernetes.io/docs/tasks/configure-pod-container/assign-cpu-resource/#cpu-units).


These terms of use (the “Terms”) of the **Cloud Jobs Service** (the "Service") are agreed by and between **Puzl Cloud**, which means **GPU Computing OÜ** (the private limited company registered in Estonia with registration code 14476114) and **you**, being a customer (“Customer”) in the meaning of the Puzl Cloud Platform customer agreement (the “Customer Agreement”). 
The Terms are in force as of the date the Customer clicks to accept the Terms, and they are incorporated into the Customer Agreement. The conditions for using the Service and capitalized terms used but not defined in these Terms have the meaning given to them in the Customer Agreement.

Puzl Cloud is an independent entity and has no affiliation or partnership with GitLab Inc. or GitHub, Inc.  
"GitLab" is a trademark of GitLab Inc., and "GitHub" is a trademark of GitHub, Inc. Their use in these Terms is purely for the purpose of identifying the Service's functionality. Puzl Cloud respects all rights of GitLab Inc. and GitHub, Inc. and their respective trademarks.

## 1. Use of the Service

1.1. The Service provides the Customer with an execution environment for the Customer's **GitLab pipeline jobs, GitHub Actions jobs or other jobs** (collectively, "Cloud Jobs”). The Service executes the Cloud Jobs initiated by the Customer via their GitLab instance or GitHub repository.  
“GitLab instance” refers to the specific deployment of GitLab software where the Customer has set up and manages their Applications and CI/CD configurations.  
“GitHub repository” refers to the code repository or organization in GitHub where the Customer manages their Applications and CI/CD configurations.

1.2. To execute Cloud Jobs using the Service, the Customer must set up GitLab runner or GitHub Actions runner using the Admin Console.

1.3. For understanding technical terms like "GitLab runner", "GitHub Actions runner", and other terms that are not defined in the Puzl Cloud Agreement or the Terms, the Customer must refer to the official GitLab and GitHub documentation, as well as Puzl Cloud's documentation.

1.4. Access to the Service is granted to the Customer through the purchase of a **Plan**. Each Plan may encompass allocations of multiple Resources, with each Resource quantified in terms of its respective **Resource Unit Seconds** or **In-Package Resource Consumption Limit**. Details about available Plans, their associated prices, included Resource Unit Seconds, included In-Package Resource Consumption Limits, and other included functionality are available on the Puzl Cloud website.

1.5. The use of the Service by the Customer entails the consumption of **Resource Unit Seconds** and **In-Package Resource Consumption Limits** from the purchased Plan, which can be managed and viewed through the Admin Console.

1.6. Puzl Cloud may introduce new features, functionality, etc., related to the Service. The use of such features may be conditional upon the Customer’s consent to additional terms.

1.7. The Customer must have an **Account** to use the Service.

1.8. Puzl Cloud may change the Terms or the Service at any time. Puzl Cloud may, at any time, terminate the availability of the Service or terminate the use of any functionality of the Service. Puzl Cloud will post any changes to the respective URL, and they will be effective immediately after posting. If the Customer does not agree to any changes to the Terms, the Customer will stop using the Service. Any use of the Service after the posting and effective date of any changes to the Terms URL will constitute the Customer’s acceptance of the Terms as modified.

## 2. General Provisions for Plan Use

2.1. To utilize Resource Unit Seconds and In-Package Resource Consumption Limits from the Plan, the Customer must set up GitLab runner or GitHub runner and execute Cloud Job, culminating in the creation of a Pod (or other processing environment) in Puzl Cloud.

2.2. Plans are designated for individual Customer Accounts and cannot be transferred, shared, or redistributed to another Puzl Cloud Customer's account.

2.3. A Plan is valid for a specified limited duration. The duration of validity for each Plan, as well as any expiration dates or conditions, are defined at the time of purchase or as stipulated in the respective Plan documentation on the Puzl Cloud website.

2.4. In the event that the Customer depletes the Resource Unit Seconds for any specific Resource within the Plan before its expiration, additional usage of that Resource will be billed on a **per-second basis** until the expiration of the Plan. The per-second pricing varies for each Resource in each Plan and is detailed in Puzl Cloud's documentation. Each Resource within a Plan is measured independently, and depletion of one does not affect the remaining Resource allocations.

2.5. Any Resource Unit Seconds not used within the Accrual Period of the respective Plan will be forfeited and will not roll over to subsequent periods or be redeemable in any form.

2.6. If the Customer's consumption surpasses the **In-Package Resource Consumption Limit** for a particular Resource, additional usage will be billed based on the exceeded amount of the Resource on a **per-second basis** during the period of such surpassing.

2.7. Plans are **non-refundable**.

2.8. Puzl Cloud reserves the right to modify the contents, Resource allocations, or specifications of any Plan. However, any changes will not affect Plan already purchased until their expiration.

2.9. Upon the expiration of a Plan, should the Customer neglect or choose not to purchase a subsequent Plan, Puzl Cloud reserves the unequivocal right to immediately restrict the Customer's access to the Service. Furthermore, Puzl Cloud may initiate the irreversible deletion of all Customer data associated with the Service. It remains the responsibility of the Customer to ensure the backup and preservation of their data prior to the expiration of the Plan or to timely purchase a subsequent Plan to ensure uninterrupted access and data preservation. Puzl Cloud will not be held liable for any loss or damage arising from the removal of such data.

## 3. Payments and Fees

3.1. **Plan via Subscriptions**. A subscription, in this context, refers to a recurring commitment where the Customer is automatically provided with a new Plan upon the conclusion of their current package, with charges applied accordingly. Once subscribed, unless cancelled, Puzl Cloud will automatically charge for the renewal using the same Plan or a different one specified by the Customer prior to the end of the current term. Payments for the renewals are automatically charged before the commencement of a new Plan, regardless of whether it follows a free trial or the conclusion of a previous package. The specifics regarding the frequency, timing, and method of these automatic charges are specified in the description of each Plan on the Puzl Cloud website.

3.2. If the Customer incurs additional usage of any specific Resource beyond its Resource Unit Seconds or In-Package Resource Consumption Limits, as outlined in Sections 2.4 and 2.6, additional fees (“Overage Fees”) will be applied in accordance with the per-second pricing detailed for the specific Plan on the Puzl Cloud website. Such Fees will be added to the subsequent invoice or automatically charged, depending on the payment method on file.

3.3. All invoicing, payment obligations, and related mechanisms concerning the Service adhere to the terms specified in the Puzl Cloud Customer Agreement, unless explicitly stated otherwise in these Terms.

3.4. While Puzl Cloud retains the discretion to offer promotional discounts or incentives, including for transitioning between Plans, such offers are not obligatory and can be modified or withdrawn at any time without prior notice.

3.5. Puzl Cloud may, at its discretion, offer **trial Plans** at no cost. Customers must ensure they are familiar with the conditions and duration of any such trial, as stipulated at the time of offering. Upon the conclusion of the trial period, unless cancelled, the Customer's chosen payment method will be automatically charged for the subsequent Plan.

3.6. Customers may cancel their subscription at any time, but any existing charges or fees are **non-refundable**.

3.7. Puzl Cloud reserves the right to modify the pricing of Plans or associated Fees. Any changes will be communicated in advance and will only apply to subsequent Accrual Periods.

3.8. In cases where automatic charges fail, Puzl Cloud may take actions including, but not limited to, notifying the Customer, re-attempting to process the payment, suspending or terminating the Service. It remains the Customer's responsibility to ensure valid payment details are on file and to address any issues that might prevent successful billing.

3.9. All Fees related to the Service do not include taxes, levies, or duties imposed by taxing authorities. Customers are responsible for paying any such taxes, including, without limitation, VAT, sales, use, or withholding taxes, as outlined in the Puzl Cloud Customer Agreement.

## 4. Customer Obligations

4.1. The Customer must use the Service in accordance with these Service Terms, the general Puzl Cloud platform terms, and any guidelines or policies provided by Puzl Cloud.

4.2. The Customer is responsible for the security of their own Applications and data. While Puzl Cloud provides infrastructure-level security, Application-level security remains the Customer’s responsibility.

## 5. Proprietary Rights; Use of Customer Data; Technical Support

5.1. Customers retain all rights and ownership of their Applications. Puzl Cloud does not claim any proprietary rights to Customer Applications.

5.2. Customers are granted a limited, non-exclusive right to use the Service. Puzl Cloud retains all rights to its software and services.

5.3. Specific levels of technical support, if available, will be detailed within the individual Plan terms.

## 6. Term and Termination

6.1. These Terms are agreed upon for an indefinite period.

6.2. The Customer retains the right to discontinue the Service at any time; however, cessation of the Service does not entitle the Customer to any refunds.

6.3. In the event that **GitLab Inc.** or **GitHub, Inc.** significantly alter the mechanics of their CI/CD system, discontinue their CI/CD offering, transition their Runner, job, or user APIs to closed-source, or make any other major changes that render Puzl Cloud's Service incompatible or inoperable, Puzl Cloud reserves the right to terminate this agreement immediately with no obligations. In such cases, while Puzl Cloud may continue to support older versions of GitLab or GitHub, there is no guarantee of continued compatibility with newer versions.

6.4. Puzl Cloud reserves the right to terminate or suspend the Service if the Customer breaches these Service Terms or the overarching Puzl Cloud platform terms.

6.5. Upon termination, the Customer is responsible for retrieving their data and applications. Puzl Cloud is not obligated to retain any Customer data post-termination.

## 7. Definitions

**Resource Unit Seconds**  
Means the service which consists of a specific Resource — be it CPU, GPU, memory, or any other defined Resource — rented by a Customer from Puzl Cloud for 1 second. The exact nature and specifications of what constitutes a "Resource Unit" is detailed and categorized on the Puzl Cloud website for the respective Service.

**In-Package Resource Consumption Limit**  
Means the volume of a specific Resource that is included within a Plan and that the Customer can consume as part of their purchased Plan without additional charges.

**Plan**  
Means an offering purchased by the Customer that encompasses pre-specified amounts of Resource Unit Seconds and In-Package Resource Consumption Limits for multiple Resources, and other associated functionalities, available for use within the Service.

Cloud Jobs Terms of Use

These terms of use (the “Terms”) of Puzl Cloud Marketplace (the “Marketplace”) are agreed by and between **Puzl Cloud**, which means GPU Computing OÜ (the private limited company registered in Estonia with registration code 14476114) and **you**, being a customer (“Customer”) in the meaning of the Puzl Cloud Platform customer agreement (the “Customer Agreement”). 

The Terms are in force as of the date Customer clicks to accept the Terms, and they are incorporated into the Customer Agreement. The conditions for using the Marketplace and capitalized terms used but not defined in these Terms have the meaning given to them in the Customer Agreement.

## 1. Use of the Marketplace

1.1. These Terms govern Customer’s access to and use of the Marketplace. The Marketplace is an online service that enables Customer to deploy and use Products made available through the Marketplace. Subject to these Terms, Customer may use the Marketplace and Products during the Term.

1.2. These Terms do not govern the terms and conditions of use of Products. The Products’ terms are governed by the third-party terms of use and software licenses associated with such Products. Customer agrees that Products are not subject to these Terms or Customer Agreement, and they are not created, owned or endorsed by Puzl Cloud. Puzl Cloud makes no representation or warranty that such Product, their compositions, descriptions, or displays are accurate, complete, or up to date. Puzl Cloud does not monitor, control, or assume any liability associated with Products and is not responsible for the quality, accuracy, or nature of such Products or the security practices or general privacy policies (including data collection or use policies) of the Providers offering such Products. Customer agrees that functionality related to Products are enforced by the Providers for such Products, and Puzl Cloud assumes no responsibility or liability for the effectiveness or accuracy of such Provider enforced functionality.

1.3. Puzl Cloud may make new features, functionality etc., related to the Marketplace, the use of which may be conditional upon Customer’s consent to additional terms.

1.4. Customer must have an Account to use the Marketplace. 

1.5. URL links on the Marketplace web pages may forward Customer to web pages not owned and controlled by Puzl Cloud (“Linked Site(s)”). Puzl Cloud is not responsible for the Linked Sites in any manner, including related content and security or privacy practices. Any access Puzl Cloud provides to Linked Sites is done solely as a Customer convenience, and the inclusion of any link to a Linked Site does not imply endorsement by Puzl Cloud of the Linked Site.

1.6. Puzl Cloud may change the Terms, the Marketplace or Products at any time. Puzl Cloud may at any time terminate the availability or use of any Product or the Marketplace. Puzl Cloud will post any changes to the respective URL, and they will be effective immediately after posting. If Customer does not agree to any changes to the Terms, Customer will stop using the Marketplace and any Products. Any use of the Marketplace or Product after the posting and effective date of any changes to the Terms URL will constitute Customer’s acceptance of the Terms as modified.

## 2. Fees

2.1. Puzl Cloud will invoice Customer and apply other payment and taxation terms as specified in the Customer Agreement unless otherwise stated in the Product description in the Marketplace for any Product used. 

2.2. If Customer or Customer End User commits to pay any minimum amount of Fees (including for any promotion or discount), Customer will be responsible for the payment of such Fees even after any termination of the Terms. 

## 3. Customer Obligations 

3.1. Customer is solely responsible for its Products, Customer Data and its (and Customer End User’s) use of the Marketplace and Products.

3.2. Products (which may include open-source software) deployed or used via the Marketplace may be subject to separate third-party license agreements and terms of use, and Customer, by agreeing to these Terms, also agrees to any applicable third-party agreements or terms related to Customer’s use of any Products. However, no third-party agreement or terms may limit the parties’ obligations and rights under these Terms; except that, to the limited extent, an open-source software license expressly supersedes these Terms open-source software license governs Customer’s use of the related Product.

3.3. Puzl Cloud may provide Documentation for Customer’s use of the Marketplace or Products. The Documentation may specify restrictions on how Products may be built or used, and Customer will comply with any such restrictions set. Puzl Cloud will not be responsible in any manner for any Provider-supplied security updates or patches described in the Documentation or otherwise provided to Customer.

3.4. If Customer becomes aware that any Customer or Customer End User use of the Marketplace violates these Terms, Customer will immediately cease such use. If Customer or Customer End User engages in such use or fails to immediately discontinue any use of the Marketplace in violation of these Terms, Puzl Cloud may suspend or cancel Customer’s use of the Marketplace or Product. 

## 4. Proprietary Rights; Use of Customer Data; Technical Support 

4.1. Except as expressly stated in these Terms, the Terms do not grant either party any rights, implied or otherwise, to the other party’s content or any of the other party’s intellectual property. As between the parties, Customer owns all Intellectual Property Rights in Customer Data and Products (if applicable). Puzl Cloud owns all Intellectual Property Rights in the Marketplace, and Providers own all Intellectual Property Rights in the Products.

4.2. Customer consents that Puzl Cloud can use data related to Customer’s usage of the Marketplace or Products to provide Product recommendations and other personalization or improvements to the Marketplace and Products offerings.

4.3. Customer is responsible for technical support of its Products. Subject to payment of any applicable support Fees, any technical support for Products will be provided by the Provider of the Product on terms that will need to be agreed to by Customer. Puzl Cloud will not be responsible or liable for any technical support to Customer for any Products, including any security updates or patches provided by Provider (even if such updates or patches appear in Documentation).

## 5. Term and Termination

5.1. These Terms are agreed upon for an indefinite period. 

5.2. Customer may stop using the Marketplace at any time. 

5.3. Puzl Cloud may remove or prohibit access to any Products in the Marketplace at any time without liability to Customer. 

5.4. Puzl Cloud may discontinue the Marketplace or any portion or feature for any reason at any time without liability to Customer.

5.5. If a Product is removed from the Marketplace, Customer shall stop all use of such Product, unless such continued use is expressly allowed by the third-party license applicable to Customer. 

5.6. If these Terms are terminated, then Customer shall stop all use of the Marketplace and any Products.

## 6. Definitions

**“Customer End User”** means the individual(s) that Customer permits to use the Marketplace or Products.

**“Product(s)”** include (i) any usable tools, software development kits, Applications or other proprietary computer software provided by Providers or Puzl Cloud in connection with deployment via the Marketplace, which Customer may use, (ii) any services provided by Providers or Puzl Cloud via the Marketplace, (iii) datasets provided by Puzl Cloud or third parties via the Marketplace, and (iv) any updates Puzl Cloud or Providers may make to (i) or (ii), or (iii).

**“Provider(s)”** means the supplier(s) providing Product(s) for deployment or usage through the Marketplace.

Puzl provides both shared and dedicated IP addresses. Shared IP addresses are assigned to your workloads for free and used by default. Traffic routing depends on a particular service.

RAM (or memory) is a type of Kubernetes resources measured in MB. You can request RAM by specifying request (minimal amount that is guaranteed to be allocated to your Workload) and limit (maximal amount that your Workload can utilize).

Memory

Pods is a service for leasing computing resources (e.g. CPU, GPU, RAM) by deploying Pods – a group of containers running in a cluster. When Kubernetes deploys a Pod, it assigns to it one of the two classes of the quality of service (QoS). Pods are offered in the following QoS classes:

### Guaranteed

- Every container in a Pod must have a RAM limit and a RAM request, and these must be the same.
- Every container in a Pod must have a CPU limit and a CPU request, and these must be the same.

### Burstable

- The Pod does not meet the criteria for the Guaranteed QoS class.

Pods as a service commences at the moment of the allocation of computing resources to Customer in a cluster. Computing resources requested for each container of a Pod shall be regarded as having been allocated from the moment a Pod obtains the `PodScheduled` condition. The Pods service shall be provided in full, and Customer shall be considered to have full ability to manage it when the allocated resources are available and the server they are located on is connected to the internet. Resources shall be regarded as having been released when all Pod’s containers are finished. The moment of such release is the moment when the last Pod’s container is finished. The Pods offered in the Guaranteed QoS class can be (automatically) finished only in case the server they are located on shuts down (becomes non-available). The Pods offered in the Burstable QoS class can be evicted from the server (finished) at any time in case the RAM used by a Pod exceeds the RAM request.  

Pods Service Level Agreement

Puzl Cloud has agreed to provide Puzl Cloud Platform services to the Customer as applicable in the Customer Agreement. This Puzl Cloud Platform Service Level Agreement (hereinafter the SLA) is a policy governing the use of the Included Services (listed below) and shall separately apply to each Customer Account using the Included Services. In the event of a conflict between the terms of this SLA and the terms of the Agreement or other agreement with Puzl Cloud governing the use of the Services by the Customer, the terms and conditions of this SLA shall prevail, but only to the extent of such conflict. Capitalized terms used herein but not defined herein shall have the meanings set forth in the Agreement.

## Included Services

Kubernetes is an open-source platform which automates operations. A cluster refers to the group of servers (bare metal or virtual machines) running Kubernetes.

## General Service Commitment

- Puzl Cloud guarantees **100% service for the Fees paid**, meaning that the Customer only pays for the time period when the Included Services are provided (the “Service Commitment”). 
- Regular maintenance. Puzl Cloud shall notify the Customer via email detailing maintenance work to be carried out and the possible impact on the Customer. Such notifications shall be given at least 36 hours prior to the maintenance being carried out, and Puzl Cloud shall endeavour, wherever practical, to keep the maintenance times as short as possible. Maintenance means any work carried out by Puzl Cloud in order to upgrade, improve or maintain the Included Service (including a telecommunications link, any hardware or software) including any modification, change, addition or replacement which does not materially detract from, reduce or impair the overall quality or performance of the Included Services. The Customer shall not pay the Fees if the provision of the Included Services during such maintenance is stopped or the Included Services are not available. 
- Puzl Cloud shall make commercially reasonable efforts to provide the Included Services to Customer with the best possible availability. The Customer however acknowledges that for technical reasons as well as due to Puzl Cloud’s dependence on external factors (e.g. unavailability of telecommunications networks, electricity outages, hardware and/or software failure etc), the uninterrupted availability of the Included Services cannot be guaranteed. The Customer can therefore not assert a claim for continual access to the Included Services. Access restrictions of a temporary nature shall not constitute grounds for warranty claims or a right to extraordinary termination. 
- Shut-down of the cluster server. Puzl Cloud specifically points out that, due to various technical reasons and its dependence on external factors, the uninterrupted uptime of a server (i.e. the period when the server is working and available) with a scheduled Kubernetes Platform Object, cannot be guaranteed. In this case a 1-minute error in computing billing Fees for is allowed.
- In the event any of the Included Services do not meet the Service Commitment, the Customer shall be eligible for a refund as described in the Customer Agreement. 


Service Level Agreement

Volume is a service for storing and accessing Customer data by allocating a data storage space in a cluster. Volumes are requested by creating a `PersistentVolumeClaim` object in the Kubernetes. Volume as a service commences at the moment of the allocation of a data storage space to the Customer in a cluster. A data storage space is allocated at the moment of the creation of a `PersistentVolume` object which is bound to the PersistentVolumeClaim. Puzl Cloud may offer various storage classes to create Volume. If there is no `PersistentVolume` object for each `PersistentVolumeClaim` for a particular storage class, the moment of the data storage space allocation is the moment when a `PersistentVolumeClaim` object acquires the `Bound` status. A data storage space shall be regarded as released at the moment when the `PersistentVolumeClaim` object acquired the `Terminated` status.

Puzl Cloud offers various versions of the Included Services. All current specifications and Fees for these versions can be found in [pricing table]({{pricingPage}}). Any service provided by Puzl Cloud free of charge may be discontinued at any time. In such case, the Customer shall not be entitled to claim the continuation of this type of service.
